These terms (“Terms”) and conditions apply to the Plates app (hereby referred to as “Application”) for mobile devices that was created by David Thomson (hereby referred to as “Service Provider”) as a free service.

Upon downloading or using the Application, you agree to the following Terms together with the Privacy Policy. You should read and understand these Terms carefully before using the Application.

Unauthorized use, copying, decompression, or modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to any and all parts of the Application remain the property of the Service Provider.

The Service Provider is dedicated to reasonably ensuring that the Application is as beneficial and efficient as possible. The Service Provider reserves the right to modify the Application or charge for its services at any time and for any reason. Any charges for the Application or its services will be clearly communicated to you.

The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service, in accordance with the Service Provider’s Privacy Policy. It is your responsibility to maintain the security of your phone and/or device and access to the Application. It is a material breach of these Terms to use or access the Application using jailbroken or rooted phones or devices, which involves removing software restrictions and limitations imposed by the official operating system of your device, as well as committing any actions that could expose the Application to having any malware, viruses and malicious programs.

Please note that the Application utilises third-party services that have their own terms and conditions. Below are links to the terms and conditions of the third-party service providers used by the Application:

Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.

If you are using the Application outside of a Wi-Fi area, please be aware that the terms of your agreement with your mobile network provider still apply. Consequently, you may incur charges from your mobile provider for data usage while using the Application, or other third-party charges. By using the Application, you accept responsibility for any such charges, including roaming data charges if you use the Application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the Application, the Service Provider assumes that you have obtained permission from the bill payer.

Similarly, the Service Provider cannot always assume responsibility for your usage of the Application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.

With respect to the Service Provider’s responsibility for your use of the Application, while the Service Provider strives to keep the Application updated and accurate, it relies on third parties for certain information made available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on the functionality of the Application, the accuracy of information related to the Application, or the availability of the Application.

The Service Provider may update the Application from time to time. The system requirements for the Application—including any additional platforms on which the Service Provider makes the Application available—may change. You will need to download updates if you wish to continue using the Application. The Service Provider does not guarantee that the Application will always be updated in a manner that is relevant to you or compatible with the particular operating system version installed on your device. However, you agree to accept updates to the Application when offered to you. The Service Provider may cease providing the Application and may terminate your right to use it at any time without prior notice. Unless the Service Provider informs you otherwise, upon any termination: (a) the rights and licences granted to you in these Terms will end; (b) you must cease using the Application and (if necessary) delete it from your device.

Health Disclaimer, Assumption of Risk, and Limitation of Liability

Nature of the Application

The Application is a digital workout logging tool that enables users to record, track, and review workout data, including but not limited to exercises performed, weights lifted, repetitions completed, sets, and general performance history.

The Application is provided for informational and record-keeping purposes only. It does not provide exercise instruction, coaching, supervision, medical advice, diagnosis, treatment, rehabilitation guidance, or personalised training programmes of any kind.

The Application does not monitor, evaluate, or verify the correctness, safety, or appropriateness of any exercise performed by you.

No Medical or Professional Advice

The content, features, and functionality of the Application do not constitute medical advice, healthcare advice, physiotherapy advice, or professional fitness instruction.

Nothing within the Application is intended to:

  • Diagnose any medical or physical condition

  • Prescribe treatment or rehabilitation

  • Provide exercise technique instruction

  • Recommend specific weights, loads, repetitions, sets, frequency, or progression

  • Replace consultation with a qualified healthcare or fitness professional

You should consult a qualified physician or other appropriate healthcare provider before beginning any new exercise programme, especially if you have any pre-existing medical condition, injury, illness, or other health concern.

If you experience pain, dizziness, weakness, shortness of breath, or any other unusual symptoms while exercising, you should stop immediately and seek medical advice.

User Responsibility

You acknowledge and agree that:

  • You are solely responsible for determining whether you are physically fit and medically able to engage in exercise.

  • You are solely responsible for selecting exercises, determining appropriate weight, repetitions, sets, rest periods, and progression.

  • You are solely responsible for ensuring that exercises are performed safely and with proper form.

  • You are solely responsible for seeking professional instruction where necessary.

The Application does not and cannot account for your individual physical limitations, health conditions, injuries, training history, fatigue levels, or technical proficiency.

All decisions regarding your participation in physical activity are made entirely at your own discretion and risk.

Assumption of Risk

You acknowledge that participation in physical exercise and strength training involves inherent risks, including but not limited to:

  • Muscle strains and tears

  • Ligament or tendon injuries

  • Joint injuries

  • Back or spinal injury

  • Cardiovascular events

  • Serious bodily injury

  • Permanent disability

  • Death

By using the Application in connection with any form of exercise or physical activity, you voluntarily and knowingly assume all risks associated with such activity.

No Warranty

The Application is hereby provided to you “As Is”. The Service Provider hereby excludes all conditions, warranties, terms and obligations, whether express or implied by statute, common law or otherwise, to the fullest extent permitted by applicable law in respect of the Application.

The Application may display historical data, trends, statistics, or progress summaries based on information entered by you. Any such data is automatically generated and is for informational purposes only.

The Application does not guarantee:

  • Performance improvement

  • Strength gains

  • Muscle growth

  • Weight loss

  • Injury prevention

  • Any specific fitness outcome

Individual results will vary and depend on numerous factors beyond the control of the Application.

Limitation of Liability

To the fullest extent permitted by applicable law, the Application and its owners, developers, operators, affiliates, licensors, and service providers shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting from:

  • Your participation in exercise or physical activity

  • Your reliance on any data, metrics, or summaries generated by the Application

  • Incorrect, incomplete, or inaccurately entered user data

  • Misuse of the Application

  • Any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to, loss of profits, loss of earnings, loss of opportunities and/or damage to reputation.

Where the Service Provider is prohibited from excluding its liability under applicable law, the Service Provider’s total liability to you shall not exceed £100.

For the avoidance of doubt, neither you nor the Service Provider can exclude liability for the following:

  • personal injury, illness, permanent disability, or death; and/or
  • damage to property; and/or
  • fraud and/or misrepresentation.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.

Indemnification

You agree to indemnify and hold harmless the Application, its owners, developers, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Application; or

  • Your participation in physical activity; or

  • Your breach of these Terms.

Acknowledgement

By accessing or using the Application, you acknowledge that you have read, understood, and agree to all the obligations within the Terms, including the Health Disclaimer, Assumption of Risk, No Warranty, and Limitation of Liability sections.

If you do not agree, you must discontinue use of the Application immediately.

Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have jurisdiction to settle any dispute arising from or in connection with these Terms or the Application. Any proceedings shall be conducted in English.

Changes to These Terms and Conditions

The Service Provider may periodically update their Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.
